5. Article 50(3) AI Act: Emotion Recognition Systems and Biometric Categorisation Systems
(99) Article 50(3) AI Act imposes an obligation on deployers of emotion recognition systems and biometric categorisation systems to inform natural persons who are exposed to those systems of the operation of the system.
(100) Recital 132 AI Act explains that the purpose of that obligation is to ensure that natural persons (including persons with disabilities) are aware that they are exposed to emotion recognition and biometric categorisation systems that can be intrusive for their privacy.
(29) See also recital 11 AI Act.
(30) See also recital 137 AI Act.
(31) Recital 136 AI Act.
The obligation therefore applies regardless of whether the persons are exposed to such systems in real-time or those systems are operated ex post.
